An Approach to Juvenile Criminal Charges Against Special Needs Kids

This is an actual case. A special needs child had an incident while he was a resident of a care facility. Over a month after the incident had passed and the child was returned home from his facility stay, the County Attorney of the county where the facility was located decided to attempt to charge the child criminally for the events which had taken place at the facility weeks prior, by mailing charging documents through the U.S. Mail, namely "Notice In Lieu Of Summons." Fed Up Mom, who lived in a county very far away, had grown tired of  the VAMPIRES using her child to create transactions which benefited only themselves. She decided she wasn't going back to VAMPIRE COUNTY OF unless her child needed to return to the care facility, period.

This was BAD BUSINESS decision by a LAZY, GREEDY, and BAD attorney.

This was a clear case of "creating transactions": the practice of literally creating redundant transactions for the sake of the transaction and for no other practical purpose. This practice has become so common, it's rampant; I just can't stand to see this happen, and so whenever I see it; I DEAL WITH IT. And so should you.

Names have been changed to protect the innocent. Mom stayed true to her word; County Attorney was NEVER heard from again.

During the first stage I believe we drafted the documents listed as included in the above set of documents to the county attorney, I don't have them anymore so I must have just turned the drafts into the final set of documents below, which we served via email (convenience, professional courtesy) and fax (Rule 5 Civil Procedure) upon the County Attorney the morning of the court hearing.



To date the Vampire County Attorney has not been heard from again...
